Terms of Service

These terms are an agreement between you and Orange Console LLC ("Pulp", "we", "us") covering your use of Pulp Editor, the writewithpulp.com website, and related services (the "Service"). By creating an account or using the Service, you agree to them. If you are using Pulp on behalf of an organization, you are agreeing on that organization's behalf and confirming you have the authority to do so.
Eligibility
You must be at least 13 years old to use Pulp, and old enough to form a binding contract where you live. If you are under 18, you may use Pulp only with the involvement of a parent or guardian.
Your account
You are responsible for the activity that happens under your account and for keeping your credentials secure. Provide accurate information when you sign up, and tell us promptly at hello@writewithpulp.com if you suspect unauthorized access. Accounts are for a single person. Do not share, sell, or transfer your account.
Access to the Service
Access to Pulp is currently offered by invitation, and some features are in active development. We may add, change, suspend, or remove features, and we may impose or adjust usage limits, including limits on AI operations. We will give reasonable notice of changes that materially reduce functionality on a paid plan.
Your content
You keep all rights to everything you write in Pulp. We claim no ownership of your content. Documents you create are stored on your device; we do not hold or control them.
You grant us a limited license to process the content you submit only to the extent needed to operate the features you use. In practice this means text you send to an AI feature is transmitted and processed to return your result. This license exists solely to run the Service, ends when the operation completes, and does not permit us to use your writing to train AI models. See the Privacy Policy for details.
You are responsible for keeping your own backups. Because documents live in your browser, clearing browser storage, switching devices, or losing a device can result in permanent loss of your work, and we cannot recover it for you.
AI features
Pulp includes AI features that generate suggestions, rewrites, and other output. AI output can be inaccurate, incomplete, biased, or unsuitable for your purpose, and similar output may be generated for other users. You are responsible for reviewing anything you use and for making sure it is accurate and appropriate. Do not rely on AI output as legal, medical, financial, or other professional advice. Between you and us, you own the output you receive from AI features, subject to the terms of the underlying provider.
Acceptable use
You agree not to:
- Use Pulp for anything unlawful, or to produce content that is illegal, harassing, defamatory, or that infringes someone else's rights.
- Reverse engineer, decompile, or attempt to extract the source code or models behind the Service, except where that restriction is prohibited by law.
- Access the Service through automated means, resell it, or use it to build a competing product.
- Circumvent usage limits, rate limits, authentication, or any other technical restriction.
- Interfere with the Service's operation, security, or availability, or with other users' use of it.
- Upload malware or use Pulp to distribute spam or bulk unsolicited messages.
We may investigate suspected violations and suspend or terminate access for conduct that breaks these rules or creates risk for us or other users.
Plans, billing, and trials
Paid plans are billed in advance on a recurring basis, monthly or annually depending on the plan you choose, through our payment processor, Stripe. Subscriptions renew automatically at the then-current rate until you cancel. You authorize us to charge your payment method for each renewal.
You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused features, or downgrades.
If we offer a free trial, we will tell you its length and terms when you start it. Unless you cancel before the trial ends, the plan converts to a paid subscription and your payment method is charged. We may change our prices; changes to an existing subscription take effect at the next renewal, and we will give you at least 30 days' notice by email.
You are responsible for any taxes associated with your subscription other than taxes on our income. If a payment fails, we may retry it and may suspend access until payment succeeds.
Our intellectual property
The Service, including its software, design, text, and the Pulp name and marks, is owned by Orange Console LLC and protected by intellectual property laws. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. We reserve all rights not expressly granted.
Feedback
If you send us feedback, ideas, or suggestions, we may use them to improve the Service without any obligation or payment to you. We will not identify you publicly as the source without your permission.
Third-party services
Pulp relies on third-party services, including authentication, AI, payment, hosting, and analytics providers. Your use of the Service may also be subject to their terms. We are not responsible for third-party services we do not control, and their availability may affect the availability of features that depend on them.
Termination
You may stop using Pulp and delete your account at any time. We may suspend or terminate your access if you breach these terms, if your use creates legal risk or harm to others, or if we discontinue the Service. If we terminate your paid account without cause, we will refund the unused portion of your current billing period. On termination, your right to use the Service ends immediately. Sections that by their nature should survive, including ownership, disclaimers, limitation of liability, and indemnification, will survive.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that it will meet your requirements, or that any output, analysis, or suggestion will be accurate or suitable for your purpose. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Orange Console LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or related to your use of the Service, whether based in contract, tort, or any other theory, even if we have been advised of the possibility of those damages. Our total liability for all claims relating to the Service will not exceed the greater of one hundred U.S. dollars or the amount you paid us in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Orange Console LLC and its officers, members, and employees from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising from your content, your use of the Service, or your violation of these terms or of any law or third-party right.
Governing law and disputes
These terms are governed by the laws of the state in which Orange Console LLC is organized, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located there for any dispute that is not otherwise resolved. Before filing a claim, you agree to contact us at hello@writewithpulp.com so we can try to resolve it informally.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the date at the top of this page, and for material changes we will give you notice by email or in the product before they take effect. Continuing to use the Service after changes take effect means you accept the revised terms.
General
These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
